1. General Provisions

1.1. All business undertaken, including any services provided by Global Hub Customs Services LLC (hereinafter referred to as "the Company"), is subject to the conditions set forth herein. All other conditions are hereby excluded.

1.2. The Company operates as a transporting agent, acting solely as an intermediary in securing services for the customer and entering into contracts on behalf of the customer with third parties.

1.3. The Company reserves the right to enter into contracts for the carriage of goods via any route or means, including the lifting, installation, storage, and handling of goods by third parties for any duration necessary.

2. Customer Authorization & Responsibility

2.1. The customer expressly authorizes the Company to act on their behalf in entering into contracts related to the transport, storage, and handling of goods.

2.2. The customer warrants that they are either the owner of the goods or an authorized agent of the owner and accept these terms on behalf of all parties with an interest in the goods.

2.3. The customer guarantees that all provided descriptions and particulars of any consignment are accurate. The customer agrees to indemnify the Company against all losses, expenses, or fines arising from any inaccuracies, unless caused by the Company's negligence.

3. Liabilities & Limitations

3.1. The Company is not obliged to make declarations regarding the nature, value, or special interest of any goods unless expressly instructed in writing by the customer.

3.2. The Company retains the right to broker commissions, allowances, and other remunerations customarily paid to forwarding agents and insurance brokers.

3.3. Insurance will only be arranged upon the written request of the customer.

3.4. Unless special arrangements are made in writing, the Company does not accept or handle hazardous, flammable, perishable, or dangerous goods. The customer shall be fully responsible for all risks, damages, and liabilities associated with such goods.

3.5. The Company will not accept bullion, coins, precious stones, jewelry, valuable antiques, artwork, livestock, or plants unless explicitly agreed upon in writing.

4. Payment & Charges

4.1. In cases where the Company is instructed to collect freight duties, charges, or other expenses from the consignee or a third party, the customer remains responsible for all unpaid charges.

4.2. The Company reserves the right to sell or dispose of goods at the customer’s expense if:

• Payment obligations are not met.

• Goods are left unclaimed or undeliverable beyond a reasonable time.
   

5. Liability Exclusions

5.1. The Company is not liable for losses or damages resulting from:

• Customer’s failure to provide correct instructions.

• Negligence of third-party carriers or agents.

• Delays, loss of market value, or indirect/consequential losses.

• Improper or insufficient packaging.

• Riots, civil unrest, strikes, labor disruptions, fires, or force majeure events.

5.2. The Company’s liability, if any, shall not exceed the actual value of the lost or damaged goods, or AED 500 per item/package, whichever is lower.

5.3. Claims must be filed within three months from the date of collection. Any claims beyond this period shall be deemed waived and absolutely barred.

6. Customs Duties & Compliance

6.1. The customer is responsible for all duties, taxes, and related expenses, including those for returned shipments, storage, and customs clearance fees.

6.2. If the consignee refuses to accept delivery, the Company will notify both the consignee and shipper through available communication channels (email, phone). If no action is taken within two months, the Company reserves the right to take appropriate actions, including disposal of the goods.

6.3. The customer agrees that all matters related to these Terms & Conditions are governed by the laws of the United Arab Emirates and subject to the exclusive jurisdiction of UAE regulatory authorities.
 

7. Special Provisions for Land & Sea Shipments

7.1. Shipments transported by land or sea are subject to additional terms and conditions outlined in the shipping agreement. Customers are responsible for inquiring about these terms prior to shipment.
